Client to Provide a Serving Area to be ready 30minutes prior to your Contracted Set Up Time
A Level 8' Banquet, 60" or 72" Round Table must be Provided by the Client. This Table should Accommodate up to 150lbs and be No More than 10' from a Grounded outlet that must Supply at least 15 amps of Continuous Power
Outdoor set ups will only be Permitted in Completely enclosed tents, equipped with Climate Control capability
Additional Fountain Time is Available at $25 per ½ Hour if Booked in Advance & $50 per ½ Hour if Booked the Day of your Event

All Unused Chocolate and Dipping Items are to be Discarded after the Function and Cannot be Kept by the Client Due to Health Department Regulations.
A $200 Deposit is Required to Hold Your Date & Will Be Credited to Your Invoice Upon Final Payment

CHOCOLATE FOUNTAIN SERVICE CONTRACT
This Contract for Chocolate Fountain Services is made between A Movable Feast, Inc. and "Client" as listed on the attached Invoice. Client is hiring A Movable Feast, Inc. subject to the following terms & conditions, divided by numbered sections.
WAGES/PAYMENT
1.The wages and/or cost of hiring of A Movable Feast, Inc. for Client shall be the Invoice total as stated on the Invoice. This amount, minus any pre-paid amounts, including deposits, must be paid in full the day of your event, unless previous arrangements have been made. Payments must be made by check, cash or money order; we do NOT accept credit cards or credit card checks. All checks and money orders will be made payable to A Movable Feast, Inc.
2. A $200.00 minimum non-refundable fee per fountain is required as a retainer for faithful performance of said duties by A Movable Feast, Inc. Retainer must be collected from Client before any provisions of this contract are valid. Once this retainer is collected, for no reason shall it be refunded, unless A Movable Feast, Inc. fails to perform duties to Client as detailed in section 4. If cancellation occurs with less than 14 days notice, full payment will be due. If this contract is not signed and dated by the Client and received by A Movable Feast, Inc. with the required retainer within 10 days of the issue date, this contract with be determined void.
3. Overtime, shall be defined as time where A Movable Feast, Inc. continues to provide services for Client before or past agreed time, overtime shall be charged as the rate of $50.00 per half hour after scheduled end time, as detailed in Section 1. Overtime is not travel, set up or takedown time, and will not be charged without verbal approval from Client or Client Representative. The parties agree that A Movable Feast, Inc. is not obligated to work past the original contracted time, but will make all efforts to do so.
PROVISIONS
4. This agreement of A Movable Feast, Inc. to perform for Client shall be excused by detention of personnel, agents, and/or employees by riots, strikes, epidemics, terrorism, acts of God, Force Majeure, death, critical injury, serious illness or any other legitimate condition beyond A Movable Feast, Inc. control. If such circumstances arise, all reasonable efforts will be made by A Movable Feast, Inc. to find replacement services at the agreed upon fees. Should A Movable Feast, Inc. be unable to procure a replacement, Client shall receive a full refund of monies already paid to A Movable Feast, Inc. Client agrees that in all circumstances, A Movable Feast, Inc. liability shall be exclusively limited to an amount equal to the agreed upon fee. The parties agree that A Movable Feast, Inc. shall not be liable for indirect or consequential damages arising from any breach of contract.
5. In the event of non-payment or partial payment, A Movable Feast, Inc. retains the right to attempt collection through appropriate courts. Purchaser will be held responsible for all attorney costs, fees, court costs and/or collection costs incurred by A Movable Feast, Inc. to collect the amount due. Purchaser shall be charged $35.00 for each returned check, plus a $10.00 service charge for each collection notice. Jurisdiction and venues shall remain the exclusive selection choice of A Movable Feast, Inc., and client hereby waives any right, claim, or defense that jurisdiction or venue are improper.
6. A Movable Feast, Inc. requires that a serving area be available and prepared at least 30minutes prior, and 30 minutes after the scheduled time for set up and take down. A Movable Feast, Inc. requires at least one grounded outlet within 10 feet from the serving area that adheres to contemporary safety standards. In addition, the outlet must supply at least 15 amps of continuous power. Client will also provide a level table with linen capable of holding at least 150 pounds.
Outdoor use is not suggested, but in the event that the equipment is used outdoors, the client must provide an enclosed tent, or other suitable covering large enough to cover and enclose all equipment for A Movable Feast, Inc. With or without a tent or proper coverage, all weather, wind or outdoor related damages are the Clients responsibility.
Preparation of the service area is the sole responsibility of the Client, even if the Client is not the owner/operator of the serving area. Failure of the serving area to be ready may necessitate a delay or cancellation of duties. In the event that a delay is experienced, A Movable Feast, Inc. shall not be obligated to extend serving times nor reduce the amount of payment due as shown on invoice.
7. Client Shall be responsible for the safety of all Client guests and A Movable Feast, Inc. equipment and employees during performance. A Movable Feast, Inc. reserves the right to end the contracted duties due to failure of the Client to provide adequate safety and security. Any damages caused to, and/or theft of A Movable Feast, Inc. equipment caused by any guests at Client's event or function is the responsibility of the Client.
8. Client agrees to assume complete liability for all claims of personal injury or property damage arising from the engagement(s) and hold A Movable Feast, Inc. harmless and with no liability in all such cases.
9. Client, and/or the person signing this agreement, including Clients representative, is at least 18years of age and has fully read all provisions of the agreement and can legally enter into the agreement on behalf of the Client.
10.This Agreement constitutes the complete understanding between the parties, unless amended by a written instrument or contract signed by A Movable Feast, Inc. and Client.
